INVITATION FOR EXPRESSION OF INTEREST (EOI) FOR THE DEVELOPMENT OF THE ADIYAN PHASE II WATER SCHEME THROUGH PUBLIC-PRIVATE – PARTNERSHIP (PPP) PROCUREMENT
The Lagos State Government (LSG) as an integral part of its vision and policy thrust has embarked on the Public Private Partnership (PPP) model as a key strategy for the accelerated delivery of its public infrastructure.
The Lagos State Government has established legal instruments/institutions that promote an enabling environment for procurement and implementation of Public Private Partnership projects in the state. These include: Lagos State Public Procurement Agency (Lagos State Public Procurement Law 2011); Office of Overseas Affairs and Investments – Lagos Global (Lagos State Public Private Partnership Law 2011) and the Lagos State Water Regulatory Commission (Lagos State Water Sector Law 2004).
Lagos, with a population of currently 24 million people and projected to be the 3rd largest megacity in the world by 2020 reaching 29 million population mark, is Nigeria’s economic and commercial nerve centre. Presently, Lagos Water Corporation (LWC) has an installed capacity of 210 Million Gallons per Day (MGD). The total installed capacity can only meet 30% of the current demand. In order to close the demand gap, LWC has developed a Lagos Water Supply Master Plan (2010 – 2020) which outlines the infrastructure development programmes into short, medium and long term phases.
The Lagos State Government, through LWC commenced the construction of 70 Million Gallons per Day (MGD) Adiyan Phase (II) Water Treatment Plant, an EPC contract under the Public Procurement and the construction has reached 65% completion. The Engineering Design of the Distribution Network of 2,369 KM length for the service coverage area has been completed through a Consulting firm engaged by the State Government. The service coverage area is the Western Axis of the State with a population over 4million.
The Lagos State Government, through LWC (the “Authority”) intends to develop “Water Distribution Network, metering and Operation/Management of New 70MGD Adiyan Phase II Water Treatment Plant (WTP)” (the “Project”) and as part of this endeavour, the Authority has decided to undertake the Project through Public-Private Partnership (the “PPP”) on Build, Finance, Operate and Transfer (the “BFOT”) basis, and has, therefore, decided to carry out the bidding. A twenty-five (25) year concession period is being proposed for this project which shall be wholly funded by the Concessionaire.
LWC now intends to invite EOI from reputable and experienced potable water plant operators, developers and investors either as individual firm on consortium with the requisite qualification and capabilities to submit applications for the purposes of being shortlisted to participate in a competitive tender for the Project.
The selected Bidder, who is either a company or consortium incorporated under the Companies & Allied Matters Act, 2004 of Nigeria or undertakes to incorporate as such prior to execution of the concession agreement (the “Concessionaire”) shall be responsible for construction, financing, procurement, operation and maintenance of the Project under and in accordance with the provisions of a long – term concession agreement (the “Concession Agreement”) to be entered into between the preferred bidder (“the Concessionaire”) and the Authority in the form provided by the Authority as part of the Bidding Documents.
2.0 PROJECT OBJECTIVE
The objective of the project is to engage a firm/consortium/investor/concessionaire with adequate experience for successful execution of works detailed in the project scope below.
3.0 PROJECT SCOPE
The project scope of work will broadly include:
(a) Construction of 2,369Km of Water Distribution Network Pipelines of varying sizes;
(b) Service Connection of over 200,000 house connections and metering, including telemetry and SCADA infrastructure;
(c) Operation and Maintenance of a newly constructed 70MGD Adiyan II (WTP);
(d) Development and Maintenance of a comprehensive Customer Database and collection of revenue;
(d) Design, Construction and Commissioning of 7.8 – 10 Megawatts Independent Power Plant (IPP).
4.0 SUBMISSION OF EXPRESSION OF INTEREST
The Lagos Water Corporation (LWC) now invites firm/consortium/investor/concessionaire to indicate their interest in providing the required Services. Interested parties shall provide information demonstrating that they have the required qualifications and relevant experience to perform the Services (brochures, description of previous similar assignments, experience in similar conditions, availability of appropriate skills amongst Staff, professional qualifications etc). The short-listing criteria are: (1) Core business and number of years in business, 2) Technical and Managerial organization of the firm, (3) Availability of Appropriate Skills among Staff. (4) Firm’s experience in similar assignments and (5) Firm’s experience in working in similar conditions and environment.
5.0 REQUIREMENTS FROM INTERESTED PARTIES
In addition, the prospective firm or consortia must possess the relevant experiences in the development, operation and management of water supply scheme. They are required to submit comprehensive information as follows:
- Full name and nationality country of registration of the company and contact person, postal address, telephone and e-mail addresses.
- Company registration including Certificate of Incorporation, certified true copies of Memorandum and Articles of Association and CAC Form C07 or the equivalent.
- Most recent 5 years Audited Financial Statements and latest Management Accounts.
- Evidence of available financing/access to credit line.
- Project team, including specialist firms/consortia and the project organogram.
- Evidence of previous experience in carrying out similar works in the development and operation of water supply schemes, providing the following details:
- Name of Project, Brief Description and Client’s contact details, (ii) Scope of Work, (iii) Contract Value, (iv) Contractual Period, ( v) Nature of Contract (PPP) preferably, (vii) Name and address of related client’s references.
6.0 SUBMISSION OF EXPRESSION OF INTEREST (EOI)

The EOI submission should include:
Six (6) hard copies (one (1) original and five (5) other copies of EOI applications) and a soft copy on CD-ROM/FLASH DRIVE to be delivered in a sealed envelope and clearly marked “ADIYAN PHASE II WATER SUPPLY PPP Project (Expression of Interest)” to the address below on or before Friday 24th February, 2017 no later than 1600 hours Nigeria time.
